On February 14th, 2022 the Governor in Council declared the public order emergency under the Emergencies Act. On January 24, 2024, Federal Court Justice Mosley found the invocation of the Act unreasonable. On February 23rd, 2024 the Federal government appealed the Federal Court's decision. This may be a long and drawn out process in the courts but there is no doubt that many Canadians suffered through the original decision. Does the Emergencies Act need to be rewritten? What should be done so that it truly is used for the protection of Canadians and not as a punishment?
